Drive With Drew Gloucester – Terms and Conditions
My aim is to provide fair, transparent, and professional tuition at all times. These Terms and Conditions are designed to protect both pupil and instructor.
These Terms and Conditions apply to all driving tuition, lesson bookings, and services provided by Andrew Hurcum (known as Drew) trading as Drive With Drew – Gloucester.
1. Definitions & Interpretation
(Same as previous version — unchanged except for business details.)
2. Driving Instructor
I am a self-employed, independent Driving Instructor and not employed by a driving school.
I am registered with the DVSA as an Approved Driving Instructor (ADI), and my registration is up to date. I display my current ADI certificate in any vehicle I use for tuition and ensure it remains valid at all times.
I hold a current DBS check, and my business is registered with the Information Commissioner’s Office (ICO) for compliance with data protection regulations.
I also hold Public Liability Insurance and Professional Indemnity Insurance covering the provision of driving tuition.
3. Driving Lessons: Booking, Cancellation & Delays
Lessons are available by pre-booked appointment only. You can book lessons by mobile phone, email, or via social media.
If you arrive more than 15 minutes late, the lesson may be treated as cancelled without notice and charged in full.
You may cancel a lesson without charge if you give at least 48 hours’ notice. If less than 48 hours’ notice is given, I may charge 100% of the full fee.
If I cancel a lesson, I will provide at least 48 hours’ notice where possible or credit you with an additional lesson at no charge.
4. Lessons: Location & Length
Lesson locations will be agreed at the time of booking. The minimum lesson duration is 1.5 hours, with optional increments of 30 minutes if agreed.
5. Fees & Payment
You must pay my fees for all lessons, and I will charge for lessons on an hourly basis. You can obtain information on current lesson fees by mobile phone or email.
Payment must be made at least 48 hours prior to the scheduled lesson by bank transfer or cash. Lessons not paid within this timeframe may be cancelled at my discretion.
Receipts will be issued only when payment is made in cash, and may be provided as a paper copy or via text message, WhatsApp, or email.
6. My Obligations
- Provide tuition with reasonable care and skill;
- Train you to a high standard but accept no responsibility for errors you make;
- Act courteously and professionally at all times;
- Follow the DVSA Code of Practice for Approved Driving Instructors; and
- Comply with all relevant laws and safety standards.
7. Your Obligations
- Hold a valid UK driving licence (provisional or full) and bring it to every lesson;
- Meet eyesight requirements and wear corrective lenses if required;
- Confirm that you are medically fit to drive and can read a number plate at 20 metres;
- Notify the Instructor immediately if your health, medication, or eyesight changes;
- Ensure your mobile phone and smart devices are switched off or silent during lessons, unless agreed otherwise;
- Behave safely and respectfully during lessons.
Abusive, aggressive, or unsafe behaviour towards the Instructor or others may result in immediate termination of tuition without refund.
You must not attend a lesson under the influence of alcohol, drugs, or any substance likely to impair driving ability. If the Instructor suspects impairment, the lesson will be cancelled, and the full fee will apply.
Risk Management & Shared Responsibility
Learning to drive involves shared responsibility for safety.
- The Instructor and Pupil will work together to manage risks and ensure safety at all times.
- Early in training, the Instructor will take greater control of the vehicle and decisions. As the Pupil’s skill and awareness increase, more responsibility will be transferred to the Pupil.
- The Instructor always retains the right to intervene — verbally or physically using the dual controls — to prevent danger or maintain safety.
- Dual controls are fitted for emergency use and to assist in demonstrations or high-risk situations.
- The Pupil agrees to follow all instructions immediately and accept that, when in control of the vehicle, they share responsibility for safety and compliance with traffic laws.
- If unsafe behaviour or repeated disregard for instruction occurs, the Instructor may terminate the lesson or course for safety reasons.
8. Vehicles, Insurance & Dashcam Use
All vehicles provided are:
- Dual-controlled, taxed, roadworthy and MOT-compliant; and
- Fully insured for driving-tuition purposes.
A dashcam system is fitted to the tuition vehicle for the safety of both Instructor and Pupil. The cameras are external, forward- and rear-facing only — no in-car or audio recording takes place.
Recordings are securely stored and may only be reviewed in the event of an incident, collision, insurance claim, DVSA, police, or legal request, or for instructor training and quality-assurance purposes. Footage may occasionally be used for training or educational purposes, but only with pupil consent and in compliance with GDPR.
In future, telematics or video systems may be used for progress tracking or feedback, always in accordance with GDPR and data protection laws.
9. Driving Tests
I will advise you when you are ready to take a test. You must provide full test details at least 15 working days before the test date.
You must bring your valid driving licence and ensure your test is correctly booked. The Instructor is not liable for DVSA cancellations or lost test fees due to missing documents.
The Instructor reserves the right to withdraw use of the vehicle for a driving test if, in their opinion, you are not test-ready or pose a safety risk.
10. Cancellation & Termination
I may terminate tuition if your conduct, progress, or commitment consistently falls below expectations. You may terminate tuition at any time provided you follow the cancellation rules in Clause 3.
11. Liability
I am responsible for foreseeable loss or damage caused by my negligence or breach of contract. I am not liable for any business losses or indirect damages. Nothing limits my liability for death, personal injury, or fraud.
12. Traffic Offences, Fines & Penalty Points
During any lesson or driving session, if you (the pupil) commit a traffic offence (for example, speeding, parking or bus lane violation, entering restricted zones, red light camera activation, or any similar offence), you will be fully responsible for paying any resulting fines, penalty points, or associated legal costs.
The Instructor will not be held liable for any offences committed while you are in control of the vehicle. If the Instructor is required to engage with, or respond to, legal or administrative notices relating to such an offence, you agree to reimburse the Instructor for any reasonable administrative costs incurred.
Nothing in this clause limits your legal rights under applicable law.
13. Vehicle Damage & Cleaning
You will be responsible for reasonable repair or cleaning costs if damage or excessive soiling occurs to the vehicle during a lesson as a result of your actions.
14. Lesson Packages, Refunds & Price Changes
Block bookings and lesson packages are valid for six months from the date of purchase unless otherwise agreed. Unused lessons may be refunded at the hourly rate in effect at the time of purchase.
Any refunds will be made using the same payment method originally used to pay for the lessons unless otherwise agreed.
The Instructor may revise lesson rates, but rate changes will not apply to lessons already paid for in full.
15. Force Majeure (Events Beyond Control)
If a lesson cannot be delivered due to circumstances outside the Instructor’s control (such as illness, vehicle breakdown, extreme weather, or emergencies), the Instructor may cancel and reschedule or refund the lesson at their discretion.
16. Consumer Rights (Distance Bookings)
If you book lessons remotely (e.g. online, by phone, or through the MyDriveTime app), you may have certain cancellation rights under the Consumer Contracts Regulations 2013. These rights do not apply once lessons have begun within the cancellation period at your request.
17. General Legal Clauses
If any clause of these Terms is found invalid or unenforceable, the remainder shall continue in full force and effect.
Failure by the Instructor to enforce any right at any time shall not be considered a waiver of that right.
These Terms constitute the entire agreement between the Instructor and the Pupil and supersede any prior discussions or representations.
18. Learner Driver Insurance & Private Practice
Where you undertake private practice with another supervising driver or in a different vehicle, you are responsible for ensuring that appropriate learner driver insurance is in place. The Instructor accepts no liability for any incident occurring outside official tuition.
19. Your Personal Information (Data Protection)
All personal information is handled in accordance with UK GDPR. Drive With Drew – Gloucester is registered with the Information Commissioner’s Office (ICO) for data protection compliance.

20. Complaints
I always welcome feedback from my students and, whilst I always use all reasonable endeavours to ensure that I provide a high standard of tuition and service to students, I nevertheless want to hear from you if you have any cause for complaint.
If you have any complaint about my tuition or other services or any other complaint about me, please raise the matter with me in person, by mobile phone, or by email.
If we cannot resolve a complaint between us, you may contact the DVSA’s Approved Driving Instructor (ADI) Registrar for further guidance.
21. Law & Jurisdiction
These Terms are governed by the law of England & Wales. Any disputes will be subject to the jurisdiction of the courts of England & Wales.

23. Acceptance
By signing or acknowledging acceptance of these Terms and Conditions, you confirm that you have read, understood, and agree to be bound by them.
24. Copyright & Brand Use
The Drive With Drew Gloucester name, logo, and social media content are protected and may not be reproduced without written consent. Pupils may not record or share in-car footage or lesson content without the Instructor’s permission.
These Terms & Conditions apply to all driving tuition, lesson bookings, and services provided by Drive With Drew Gloucester, including any made through the MyDriveTime app.
